These Terms & Conditions (“Terms”) govern your use of the Count Race mobile application (“Count Race”, “the App”), operated by ARTEM KRAVCHENKO IT CORP (“we”, “us”, “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Count Race is an educational/entertainment game that includes practice and race modes. Some modes may include temporary competitive elements (such as comparison during a Nearby race).
2. Eligibility and Children
The App is a general-audience educational and entertainment game. The App may be used by children, including those under the age of 13, with the involvement and permission of a parent or legal guardian..
3. Accounts
You may use the App with an anonymous account or, optionally, by creating an account using an email address and password. An email address is not required to play the App and is used only for account recovery, security, or changing account details. In some situations (for example, password recovery or changing the email address), we may require email verification.
You are responsible for keeping your credentials secure and for all activity under your account.
4. Gameplay, Scores, and Fair Use
The App stores gameplay data such as scores and progress to provide the experience. Competitive comparison may be shown only during an active Nearby race. After the race ends, users can view their own results and statistics only.
You agree not to:
- Attempt to cheat, exploit, or manipulate scores or gameplay
- Reverse engineer or interfere with the App’s security or networking
- Use automated tools (bots) to gain unfair advantage
- Disrupt the App or try to access systems without authorization
5. Optional Donations
Count Race is free to use. We may offer optional one-time donations through non-itemized in-app purchases to support the project (“Donations”).
Donations do not provide gameplay advantages and do not represent the purchase of items or services. Refunds are handled according to Apple App Store / Google Play policies and applicable law.
6. Intellectual Property
The App, including its code, design, graphics, text, and other content, is owned by ARTEM KRAVCHENKO IT CORP or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App unless we give you written permission.
7. Availability, Updates, and Changes
We may update the App to improve performance, fix bugs, or add/remove features. We do not guarantee that any feature will remain available forever.
8. Termination
We may suspend or terminate access to the App if:
- You violate these Terms
- We must do so to protect users, the App, or security
- We are required by law or a legitimate request
9. Disclaimers
The App is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, ARTEM KRAVCHENKO IT CORP will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App.
11. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. (Some countries may give you additional rights that cannot be waived; these Terms do not limit those rights.)
